Any department or individual utilizing University resources to send email advertising or promoting a commercial product or service must conform to the CAN-SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing). Note that all mailings of this sort must also conform to all other existing University policies (e.g., the use of University resources for personal gain is typically prohibited).
This Act sets forth rules and required procedures for commercial marketing of products or services via e-mail to potential customers. Some of the most significant items that must be included in commercial e-mails are:
- A non-deceptive subject line, From, and To fields
- An opt-out mechanism to unsubscribe from the sender's e-mail list
- The message must be identified as an advertisement or solicitation
- The message must contain the sender's physical mailing address.
